Nyxwyn Terms of Use

These terms are the agreement between you and J. Patrick Hanley, EI (entrepreneur individuel), a sole trader based in France (La Grande Blottière, 53200 Fromentières, France; registration in progress, SIRET number to appear here once issued), who makes Nyxwyn ("we", "us"). By creating an account or using Nyxwyn, you agree to them. Please also read our Privacy Policy, which explains what happens to your data.

If you are a consumer, nothing in these terms takes away rights you have under the law of the country where you live.

1. What Nyxwyn is

Nyxwyn is a private dream journal. You can write or dictate your dreams, keep an Analytical Journal of your own reflections, see your journal on a calendar, and set daily reminders. With a premium subscription, and only if you switch it on, Nyxwyn identifies the themes in your dreams and shows how they recur in reports and a wind rose.

2. Not medical or therapeutic advice

Nyxwyn is a journal and a way to notice patterns in your own writing. It is not a medical, psychological or therapeutic service, and nothing in it is health advice or a diagnosis.

4. Your content stays yours

Everything you write in Nyxwyn (dreams, Analytical Journal entries) belongs to you. You give us only the permission we need to run the service for you: to store it, show it to you, back it up, and, if you switch on theme identification, send it to our AI provider to identify themes, as described in the Privacy Policy. This permission ends when you delete the content or your account. We do not publish your content, sell it, or use it to train AI models.

You are responsible for what you write. Please do not put other people's private information in your journal unless you have a good reason to.

5. Free features and premium

Free: writing and dictating dreams, the journal and calendar with your streak, daily reminders, colour themes, the Analytical Journal, and account deletion.

Premium: theme identification, reports for each period (week, month, season, quarter, year), the wind rose, and the premium colour themes. Theme identification is optional even with premium: it only runs if you switch it on. Switching it off is your choice and does not change your subscription: it does not cancel it, pause it, or entitle you to a refund, and it does not delete any themes or reports already created. When you switch it back on, it applies to dreams you seal from then on; dreams sealed while it was off are not processed automatically. The app will offer, once, to catch up on them. The catch-up only runs if you accept, never includes dreams you have marked private, and costs nothing extra: it runs within your monthly fair-use limit, after your new dreams, using no more than half of each month's limit plus any part of the limit still unused near the end of the month. With many earlier dreams it can take several weeks. You can stop it at any time in Settings. Reports already created are not rebuilt.

We may add, change or remove features over time. If we remove a premium feature you have paid for in a way that significantly reduces what you get, we will tell you in advance and you can cancel; where the law requires it, we will offer a proportionate refund through the store you paid with.

Fair use. Theme identification costs us money every time it runs. To keep the price fair for everyone, each account has a monthly usage limit, set generously enough for daily journaling and shown in Settings. If you reach it, dreams are still saved and sealed normally, and their themes are identified when the limit resets the next month. We may raise the limit at any time. We will only lower it from your next renewal, and we will tell you in the app and by email at least 30 days before it applies, so you can cancel before renewing if you prefer.

If you break these rules seriously or repeatedly, we may suspend or close your account. Unless the breach is serious or the law prevents it, we will tell you first and give you a chance to put it right.

8. Our licence to you

We give you a personal, non-exclusive, non-transferable licence to use the Nyxwyn app on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you downloaded it from. The app, its design, its name and logo, and its theme-identification method belong to us. If you downloaded Nyxwyn from the App Store, the licence also follows section 13 below.

9. Availability and changes to the service

We work to keep Nyxwyn running and your data safe, but we cannot promise it will always be available or free of errors. We may need to pause the service for maintenance or updates. Some features need an internet connection. We recommend keeping the app up to date.

If we ever decide to close Nyxwyn, we will give you at least 60 days' notice so you can save a copy of your journal, and we will refund any unused part of a subscription where the law requires it.

10. Liability

We provide Nyxwyn with reasonable care and skill. To the extent the law allows:

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or deliberate wrongdoing, or anything else the law does not allow us to limit. If you are a consumer, you keep your legal guarantee of conformity for digital content and services.

11. Ending the agreement

You can stop at any time by deleting your account in Settings (and cancelling your subscription in the store). We can end the agreement or close your account under section 7, or if we close the service under section 9. Sections that by their nature should continue (such as 2, 10 and 14) continue after the agreement ends.

12. Changes to these terms

We may update these terms, for example when we add features or the law changes. We will update the date at the top. For significant changes we will tell you in the app at least 30 days before they apply. If you do not agree, you can cancel and delete your account before they apply; if you keep using Nyxwyn after that, the new terms apply.

14. Law and disputes

These terms are governed by French law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of the country where you live.

If something goes wrong, please write to [email protected] first; most problems can be sorted out quickly. If we cannot settle a dispute together, consumers can use, free of charge, a consumer mediator (médiateur de la consommation). Our registration is in progress; the mediator's name, website and address will appear here before paid subscriptions open. You may also bring a claim before the competent courts: if you are a consumer, that includes the courts where you live.

15. General

If a court decides part of these terms is invalid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer this agreement to someone else; we may transfer it to a business that takes over Nyxwyn, provided your rights are not reduced, and we will tell you if that happens. A French version of these terms is available at nyxwyn.com/fr/conditions. If the two differ, the French version prevails for consumers in France.
